These terms and conditions (the "Terms and Conditions") govern the use of madeinalignment.com.au (the "Site"). This Site is owned and operated by M.I.A (AUST) Pty Ltd ACN 002 614 539. This Site is an ecommerce website.

 By using this Site, you indicate that you have read and understand these Terms and Conditions and agree to abide by them at all times.

Payments

Products purchased on our Site must be paid for online at the time of placing your order.

The prices displayed on our Site for products are current at the time of display but are subject to change. All prices are advertised in Australian dollars and are inclusive of GST (as that term is defined in A New Tax System (Goods and Services Tax) Act 1999 (Cth)).

If products are listed at an incorrect price due to typographical error or error in pricing information received from our suppliers, we will inform you about the error as soon as we can, and let you know that we will cancel the order or part of an order for the incorrectly priced goods or services whether or not the order has been confirmed and your payment processed. If your payment has already been processed, we will issue you a refund for the order or part of the cancelled order as the case may be.

We accept all major credit cards. Please provide the billing address and telephone number associated with your credit card as incorrect information may cause a delay in the processing of your order.

Refunds may take up to 5 to 7 business days to appear on your statement.

If we believe your payment has violated any law or these Terms and Conditions, we reserve the right to cancel or reverse your transaction.

Shipping and Delivery

When you purchase goods from our Site, the goods will be delivered through one of the following methods:

• Standard delivery by post. Delivery takes 5 - 7 business days.

Delivery will take place as soon as reasonably possible, depending on the delivery method selected. Delivery times may vary due to unforeseen circumstances. Please note that delivery times do not include weekends and public holidays.

You will be required to pay delivery charges in addition to the price for the goods you purchase.

You are required to provide us with a complete and accurate delivery address, including the name of the recipient. We are not liable for the delivery of your goods to the wrong address or wrong person as a result of you providing us with inaccurate or incomplete information.

Refunds

Refunds for Goods
 Refund requests must be made within 7 days after receipt of your goods.

We accept refund requests for goods sold on our Site for any of the following reasons:

• Good is broken; or
• Good does not match description.

Refunds do not apply to the following goods:

• Gift cards,

• Health and personal care items

• Underwear

• Sale items

Returns

Returns can be made by mail. To return a good by mail, follow the following procedure:
 Pack your goods and attach the return label that was included in your package. Go to your nearest post office and pay the necessary postage.

Consumer Protection Law

Where the Australian Consumer Law, Schedule 2 of the Competition and Consumer Act 2010, or any other consumer protection legislation in your jurisdiction applies and cannot be excluded (“Non-Excluded Protection”), these Terms and Conditions will not limit your legal rights and remedies under that legislation. These Terms and Conditions will be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms and Conditions and that legislation, the mandatory provisions of the legislation will apply.

Our promotion and provision of goods and products is only an invitation to treat and does not constitute an offer to sell or guarantee the availability of any good or product.

To the maximum extent permitted at law, our liability and that of our officers, employees, agents, contractors, service providers, successors and assigns, for a failure to comply with a Non-Excluded Protection, is limited to, at our option:

• replacement of the goods or products or the supply of equivalent goods or products;
• payment of the cost of replacing the goods or products or of acquiring equivalent goods or products;
• repair of the goods or products;
• payment of the cost of having the goods or products repaired;
• resupply of the services or the supply of equivalent services;
• payment of the cost of having the services resupplied; or
• payment of the cost of having equivalent services supplied.

In circumstances where the Non-Excluded Protections do not apply, we and our officers, employees, agents, contractors, service providers, successors and assigns exclude liability for any loss or damage whatsoever (including but not limited to direct, indirect, incidental, special, consequential or exemplary damages) you may suffer arising out of, or in any way related to use of the goods or products.

You acknowledge that you do not rely on the skill or judgment of us or anyone on our behalf when deciding whether or not the goods or products are fit for any particular purpose, and that you have instead satisfied yourself that the goods or products are fit for your required purpose.

All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.
